SECTION 1A – INTERNATIONAL ORDERS VIA GLOBAL-E

For orders placed from outside Australia, Global-e acts as the merchant of record. When purchasing internationally, you are contracting with Global-e and not directly with Toolbox Widget Inc. Global-e is responsible for processing your payment, collecting applicable duties and taxes, and managing international logistics and delivery.

Toolbox Widget remains responsible for the products themselves, including warranty coverage and support. For any international billing, customs, or delivery-related issues, please refer to Global-e’s contact information provided at checkout or in your order confirmation.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot lawfully be excluded, restricted, or modified by agreement.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

The disclaimers and limitations in Section 10 (Disclaimer of Warranties) and Section 11 (Limitation of Liability) apply only to the extent permitted by law and do not exclude or limit any rights or remedies you have under the Australian Consumer Law. Where goods or services supplied to you are not of a kind ordinarily acquired for personal, domestic, or household use or consumption, our liability for a failure to comply with a consumer guarantee is limited, at our option, to the replacement or repair of the goods, the resupply of the services, or the cost of doing so.

SECTION 13 – SEVERABILITY AND WAIVER

SECTION 14 – GOVERNING LAW

For purchases made directly through Toolbox Widget Inc., these Terms are governed by the laws of the State of Montana, USA, without regard to conflict of law principles.

For international orders made through Global-e, separate terms and governing law as provided by Global-e may apply.

SECTION 15 – DISPUTE RESOLUTION

At our discretion, any dispute arising from these Terms or the use of the Website may be submitted to final and binding arbitration in accordance with the rules of the American Arbitration Association.

This dispute resolution provision does not apply to the extent that it is inconsistent with the Australian Consumer Law or any other applicable law, and nothing in these Terms requires an Australian consumer to submit to arbitration any claim or remedy that cannot lawfully be the subject of a mandatory pre-dispute arbitration agreement. Australian consumers retain the right to pursue remedies before the courts and tribunals of their State or Territory.

SECTION 16 – TIME LIMITATION

Any claim or cause of action you may have relating to the Website or these Terms must be filed within one (1) year after it arises, or it is permanently barred.

SECTION 17 – ENTIRE AGREEMENT

These Terms, together with our Shipping Policy, Privacy Policy, Returns and Warranty Policy, and any posted guidelines or disclaimers, constitute the entire agreement between you and Toolbox Widget regarding the Website.
